Explore the ethical rules surrounding the unauthorized practice of law

The unauthorized practice of law, (UPL), is "engaging in the practice of law by persons or entities not authorized to practice law pursuant to state law or using the designations “lawyer,” “attorney at law,” counsellor at law,” “law,” “law office,” “J.D.,” “Esq.,” or other equivalent words by any person or entity not authorized to practice, the use of which is reasonably likely to induce others to believe that the person or entity is authorized to engage in the practice of law in the state." As duly licensed attorneys with Bar Association oversight, there are strict Ethical Rules we must observe, as well as offices to run, insurance, staff and associates to pay, and a right to fees which are earned for the professional services we provide. On the other hand, a tension arises when consumers need certain services which they may believe are too costly if performed by a bona fide lawyer or firm. This course outlines those tensions and the balancing factors which certain states have used to address these issues, and takes a close look at several situations in which non-lawyer entities may pose a risk to the public, and where lawsuits have been necessary to limit or curtail these non-lawyer entities.
