About This Course

Lawyers routinely act for clients experiencing some of the most stressful and traumatic events of their lives. Family breakdown, personal injury, discrimination, workplace disputes, criminal allegations, financial loss, and abuse can profoundly affect a client's ability to communicate, make decisions, recall events, and participate effectively in legal processes. At the same time, repeated exposure to client trauma can influence a lawyer's own professional judgment, decision-making, and wellbeing.

This session examines the practical and ethical implications of trauma within legal practice. The course explores how trauma can affect client behaviour, credibility assessments, instructions, communication, and litigation strategy, while also considering the professional responsibility issues that arise when lawyers work in emotionally demanding environments. Participants will gain practical tools for maintaining professional boundaries, improving client interactions, and supporting sound legal decision-making without compromising their ethical obligations.

Key Topics Discussed:

  • Understanding trauma in legal practice
  • Trauma and client decision-making capacity
  • Memory, credibility, and evidentiary considerations
  • Interviewing and information-gathering challenges

  • Secondary trauma and compassion fatigue
  • Ethical obligations and professional competence
  • Managing difficult client interactions
