The American Legal System

This presentation will serve as an examination and a review of the fundamentals of our legal system. Our studies include the American court system, criminal vs. civil law, and so on. The offering will aid those who wish to better understand how our law works and affects us.

Understanding our legal system is crucial, whether for personal knowledge, professional development, or navigating daily life. This course cuts through the complexity, offering clarity on key concepts and structures.

This session explores:

• The nature and definition of law and how it governs relationships among individuals and with society.
• The structure of the U.S. government, its branches (executive, legislative, judicial), and sources of law, including statutes and case law.
• The adversarial system and fundamental differences between civil and criminal law, covering parties (plaintiff vs. defendant, prosecution vs. accused), burdens of proof (preponderance of the evidence vs. beyond a reasonable doubt), potential outcomes (damages/liability vs. fines/imprisonment), and clarifying the concept of Double Jeopardy.
• Key areas within civil law, such as Torts (including negligence with its elements: duty, breach, causation, damages; intentional torts like assault and battery; and strict liability/products liability).
• An introduction to criminal law, including crimes, prosecution, and the fundamental rights of the accused guaranteed by the Constitution.
• The structure and function of the Federal Court System, from District Courts to the Courts of Appeal and the Supreme Court, including concepts like original and appellate jurisdiction.
• Seminal legal principles such as judicial review (exploring the landmark case of Marbury v. Madison) and stare decisis (standing by decided things/precedent).
