Demystifying the Future of Currency: Understanding Central Bank Digital Currency and Its Implications

A central bank digital currency (CBDC) is a digital form of a nation’s fiat currency, issued and regulated by its central bank. Since these digital currencies are regulated by a central authority, they are generally perceived as more stable and secure than cryptocurrencies. CBDCs are an emerging element of the domestic and international financial landscape that is being introduced through varying models, creating new legal and regulatory questions about their issuance and use. Danie Garrie, Esq., is the Co-Founder of Law & Forensics LLC, where he heads the Computer Forensics and digital discovery Cybersecurity teams. Daniel has been a dominant voice in the computer forensics and cybersecurity space for the past 20 years, as an attorney and technologist. He is an adjunct professor at Harvard for Computer Forensics, and prior to Law & Forensics, he successfully built and sold several technology start-up companies. Since co-founding Law & Forensics LLC in 2008, Daniel has built it into one of the leading boutique firms specializing in cybersecurity and forensic engineering. He is a mediator, arbitrator, and e-discovery special master for JAMS and is a partner and head of Cybersecurity practice at Zeichner, Ellman & Krause LLP. Daniel earned both a Bachelor’s and a Master’s degree in computer science from Brandeis University, as well as a J.D. from Rutgers Law School. Daniel has led cyber and forensic teams in some of the most visible and sensitive incidents in the United States. He and his team have worked globally for two of the top five banks and dozens of the largest private and public companies in the world. In addition, Daniel has been awarded several patents for advanced cybersecurity and forensic platforms he built with his team, including TableTop.AI, CustodyTrack.IO, and Forensic Scan. Daniel is also well-published in the cybersecurity space and has authored more than 200 articles and books. His work is cited by Black’s Law Dictionary 10th Ed. defining the terms 'software', 'internet', and 'algorithm'. Lastly, he has been recognized by several United States Supreme Court Justices for his legal scholarship and is a trusted source and thought leader for cybersecurity articles and opinions, cited over 500 times to date.

David Cass is a senior partner at Law & Forensics LLC, where he leads the Cryptocurrency and Digital Banking Practice and is a member of the Cyber Security and Forensics Practice. He most recently served as a lead regulator for the Federal Reserve Bank of New York, where he was a member of the Large Institution Supervision Committee (LISCC). Prior to this appointment, David was the CISO & Global Partner of IBM’s Cloud Security Service Unit, where he was responsible for its security practices, processes, and policies. He has been an active contributor to the FS-ISAC and the European Banking Federation on Cloud Compliance and Security for financial services firms and has worked closely with US and international regulators. He was part of the team that introduced the first financial services blockchain initiative utilizing public cloud, supported by 10 major international banks. Previously, he served as SVP & CISO for Elsevier, where he led an organization of experienced legal, risk, and security professionals who provided data protection, privacy, security, and risk management guidance on a global basis. He also served as Elsevier’s HIPAA officer. David has an MSE from the University of Pennsylvania and an MBA from MIT. He is a frequent speaker at high-profile conferences and serves on a public corporation’s Board of Directors. He also serves as an editorial board member for The Journal of Law & Cyber Warfare and as a board member for the UCLA Extension Silicon Beach Innovation Lab. He is a faculty member for the non-profit Global Cyber Institute and an adjunct faculty member for Harvard and at the Rutgers Law School. He is a member of the New York City Cyber Critical Services & Infrastructure team organized by the NYPD and the office of the NY District Attorney. In his free time, David is a volunteer firefighter & Swiftwater Rescue Technician.

Josh is the firm’s U.S. Head of Fintech and Head of Blockchain and Digital Assets. Chip Poncy is the global head of financial integrity and a board member at K2 Integrity. Additionally, he serves on the boards of FinClusive and Atomic 47, two financial security and technology companies dedicated to financial inclusion. He is also a senior advisor for the Foundation for Defense of Democracies’ Center on Economic and Financial Power. Chip advises various financial institutions, including banks, on financial crimes compliance and risk management remediation, transformation, and enhancement. Prior to K2 Integrity, Chip spent more than a decade as a Senior Advisor at the U.S. Department of the Treasury, and was the inaugural Director of the Office of Strategic Policy for Terrorist Financing and Financial Crimes. Chip assisted Treasury leadership in developing the U.S. government’s post-9/11 strategy to combat terrorist financing and led an office of advisors in creating policies and initiatives to combat the full spectrum of illicit finance. Chip also led the U.S. delegation to the Financial Action Task Force (FATF), co-chaired the policy working group of the FATF, and managed U.S. participation in various G7, G8, and G20 illicit finance expert groups. Chip began his career as an associate in the New York offices of White & Case, and has served as general counsel to biotechnology and internet radio companies. He co-pioneered a graduate course on national security and the international financial system as an adjunct associate professor at Georgetown University. Chip graduated with honors from Harvard University (B.A. in government) and the Johns Hopkins School of Advanced International Studies (M.A. in international relations), and he holds a J.D. from the Georgetown University Law Center.
