Today, cyber threats are ubiquitous across businesses and borders. The increasing integration and subsequent dependence on digital devices in private and professional life amplify the vulnerabilities that malicious actors can exploit through cyber-attacks and data breaches. While these issues begin in the realm of technology, they can rapidly spread to affect data privacy, intellectual property, financial loss, and reputational damage, and increasingly extend into legal and regulatory repercussions. Knowledge of the current cybersecurity landscape, organizations’ biggest vulnerabilities, and an overview of the existing and developing regulatory landscape, will enable legal professionals to better understand their role in preventing and responding to cyber threats. This process, in turn, will enhance attorneys’ ability to communicate their risk management priorities to other departments in their organization, allowing for a more cohesive response to this developing risk landscape.

Danie Garrie, Esq., is the Co-Founder of Law & Forensics LLC, where he heads the Computer Forensics and digital discovery Cybersecurity teams. Daniel has been a dominant voice in the computer forensics and cybersecurity space for the past 20 years, as an attorney and technologist. He is an adjunct professor at Harvard for Computer Forensics, and prior to Law & Forensics, he successfully built and sold several technology start-up companies. Since co-founding Law & Forensics LLC in 2008, Daniel has built it into one of the leading boutique firms specializing in cybersecurity and forensic engineering. He is a mediator, arbitrator, and e-discovery special master for JAMS and is a partner and head of Cybersecurity practice at Zeichner, Ellman & Krause LLP. Daniel earned both a Bachelor’s and a Master’s degree in computer science from Brandeis University, as well as a J.D. from Rutgers Law School. Daniel has led cyber and forensic teams in some of the most visible and sensitive incidents in the United States. He and his team have worked globally for two of the top five banks and dozens of the largest private and public companies in the world. In addition, Daniel has been awarded several patents for advanced cybersecurity and forensic platforms he built with his team, including TableTop.AI, CustodyTrack.IO, and Forensic Scan. Daniel is also well-published in the cybersecurity space and has authored more than 200 articles and books. His work is cited by Black’s Law Dictionary 10th Ed. defining the terms 'software', 'internet', and 'algorithm'. Lastly, he has been recognized by several United States Supreme Court Justices for his legal scholarship and is a trusted source and thought leader for cybersecurity articles and opinions, cited over 500 times to date.

Founding Partner | Mullen Coughlin
Jennifer A. Coughlin is a Founding Partner of Mullen Coughlin and its Managing Member, guiding the Firm in its commitment to provide effective and efficient data privacy and security legal services and develop, maintain and grow client and partner relationships. She focuses her legal practice solely on providing organizations of all sizes and from every industry sector in first-party data privacy and security incident response and third-party data privacy defense legal services. Jenn has counseled hundreds of organizations in investigating and responding to data privacy and security incidents compromising protected data and network and system security, such as ransomware attacks, business email compromises (BECs) and other network intrusions, among others. She works closely with various organizational and third-party incident response stakeholders including cyber insurance claims teams; forensic investigation and data mining firms; law enforcement; and business partners. Once the incident is contained and the nature and scope is identified, she relies on her knowledge of state, federal and international laws, as well as industry-specific guidance and regulations to assist the victim organization with identifying and complying with legal obligations stemming from the incident. While Jenn has represented organizations from virtually every industry group, she has a particular focus on organizations within the healthcare and life sciences; financial services; hospitality and entertainment; retail/e-commerce; and professional services industry groups. She also represents these organizations with follow-up inquiries related to data privacy and security incidents by state, federal and international regulatory agencies, including state attorneys general; state insurance and health departments; the Federal Trade Commission (FTC); and the U.S. Department of Health and Human Services’ Office for Civil Rights (HHS-OCR). John C. Sciaccotta has more than 35 years of trial and litigation experience advocating for clients in complex civil litigation, arbitration, mediation, and business counseling matters, with a special emphasis on complex civil trial and appellate cases brought in federal and state courts and tribunals throughout the United States. John represents publicly and privately held domestic and foreign business entities, lenders, employers, municipalities, government bodies, and individuals in transactional matters and disputes. He has substantial experience representing real estate owners/developers, business owners in a wide array of industries, professional service organizations, partnerships, limited liability companies, manufacturing, construction, technology, professional sales companies, municipalities, hedge funds, broker/dealers, governmental bodies, banks, and lending institutions. Additionally, he has significant experience working with professional sports leagues, owners, and players, including representing the Arena Football League, its individual teams, and owners for many years. In addition, John has been appointed as a Neutral Arbitrator and Mediator for many years to resolve and arbitrate business-related disputes. He serves on the Commercial Panel of the American Arbitration Association's National Roster of Arbitrators. John is active in firm leadership, serving on the firm's Executive Management Committee. He is the founder and co-chair of the firm's Business Divorce practice group, the chair of the Commercial Litigation marketing group, a founding member of the firm's DEI Committee, and co-chair of the firm's Marketing Committee.

Fresh Del Monte Produce, Inc. - Vice President, Global Litigation, Labor & Employment Law, and Government Relations
Gail is a Vice President in the Legal Department at Del Monte Fresh Produce, where she is responsible for Global Litigation, Labor & Employment, and Government Relations. She is an expert on cybersecurity, privacy, and legal issues associated with data collected and used by emerging technologies, including AI, biometric devices and sensors, autonomous vehicles, the Internet of Things, blockchain, and the metaverse. She is also one of the few defense lawyers to have been involved in the trial of a class action to verdict before a jury. Gail has taught Law for Knowledge Innovation at Columbia University and is a Fellow at the Center for Legal Innovation at Vermont Law School. She has taught technology law courses for judges at the National Judicial College and the New York State Judicial Institute, and has guest lectured on vehicle data regulation at Stanford University, the Wharton School, and Interpol. Gail founded and leads the Cybersecurity Subcommittee of the New York State Bar Association’s Committee on Technology and the Legal Profession and is a former Chairperson of that Committee. She also serves as Co-Chair of the National Association of Women Lawyers’ Intellectual Property & Technology Affinity Group. An internationally recognized thought leader, Gail served as a peer reviewer for Interpol’s Framework for Responding to a Drone Incident and was a speaker at Interpol’s 2019 Car Cyber Threats Expert Group Meeting. A member of the Atomium – European Institute for Science, Media, and Democracy’s AI4People Automotive Committee, she co-authored a paper, AI4People: Ethical Guidelines for the Automotive Sector – Fundamental Requirements and Practical Recommendations, published in the International Journal of Technoethics (Volume 12, Issue 1, January-June 2021). She is also a member of the ITU’s Focus Group on AI for Autonomous and Assisted Driving and a contributor to its recently published report, Automated Driving Safety Data Protocol – Ethical and Legal Considerations of Continual Monitoring. Gail was selected as one of the Profiles in Diversity Journal’s 2017 Women Worth Watching in STEM and one of the Connecticut Technology Council’s 2016 Women of Innovation. She is a graduate of the University of Pennsylvania Law School and served as a law clerk in the Philadelphia County Court of Common Pleas.
