We begin by refreshing foundational concepts of evidence law, including relevance and character evidence under the Federal Rules of Evidence. You will then master the intricate nuances of:

  • Hearsay in the Digital Age: Understand its historical context and modern application to digital communications like emails, text messages, and social media, alongside critical exceptions.
  • Authenticating Digital Evidence: Learn practical strategies and pitfalls for verifying the integrity and origin of electronic information, from social media posts to website content.
  • Expert Testimony & Emerging Technologies: Explore the role of expert witnesses in complex digital cases, applying the Daubert standard to cutting-edge areas.
  • The Brave New World of AI-Generated Evidence: Confront the legal implications of chatbots, AI prompts, fabricated documents, deepfakes, and predictive models, understanding their admissibility challenges and ethical considerations.

Prepare to confidently identify, analyze, and present digital evidence, ensuring fairness and accuracy in the pursuit of justice in our increasingly digital age.
