Mastering eDiscovery Techniques and Legal Compliance for Social Media Data
In the space of a decade, social media has become a part of many people’s daily lives, across a range of platforms, interests, and demographics. This phenomenon of posting, commenting, and private messaging has generated an abundance of potential evidence relevant to lawsuits. As this form of digital evidence has become more prominent, it has become increasingly important for attorneys to understand the way that this data is retrieved, as well as the relevant rules of preservation and spoliation. Failing to comprehend these nuances can result in the exclusion of crucial social media evidence or poor communication and oversight of technical experts, potentially impacting the outcome of legal proceedings. As the role of social media continues to grow and evolve, attorneys today will want to be able to leverage its potential for the litigations and uphold ethical responsibilities in the process.
In this seminar, our expert panelists begin by introducing eDiscovery and how it is used for social media data. Next, our speakers dive into the type of information that is included in social media evidence as well as accessing data that has been stored by an app or deleted by a user. The conversation continues with a discussion on the preservation and spoliation of social media evidence. Our panelists conclude with the key factors essential to the authentication of social media evidence and recent relevant cases.

Danie Garrie, Esq., is the Co-Founder of Law & Forensics LLC, where he heads the Computer Forensics and digital discovery Cybersecurity teams. Daniel has been a dominant voice in the computer forensics and cybersecurity space for the past 20 years, as an attorney and technologist. He is an adjunct professor at Harvard for Computer Forensics, and prior to Law & Forensics, he successfully built and sold several technology start-up companies. Since co-founding Law & Forensics LLC in 2008, Daniel has built it into one of the leading boutique firms specializing in cybersecurity and forensic engineering. He is a mediator, arbitrator, and e-discovery special master for JAMS and is a partner and head of Cybersecurity practice at Zeichner, Ellman & Krause LLP. Daniel earned both a Bachelor’s and a Master’s degree in computer science from Brandeis University, as well as a J.D. from Rutgers Law School. Daniel has led cyber and forensic teams in some of the most visible and sensitive incidents in the United States. He and his team have worked globally for two of the top five banks and dozens of the largest private and public companies in the world. In addition, Daniel has been awarded several patents for advanced cybersecurity and forensic platforms he built with his team, including TableTop.AI, CustodyTrack.IO, and Forensic Scan. Daniel is also well-published in the cybersecurity space and has authored more than 200 articles and books. His work is cited by Black’s Law Dictionary 10th Ed. defining the terms 'software', 'internet', and 'algorithm'. Lastly, he has been recognized by several United States Supreme Court Justices for his legal scholarship and is a trusted source and thought leader for cybersecurity articles and opinions, cited over 500 times to date.

Jennifer M. Hoekstra is a partner with Aylstock, Witkin, Kreis & Overholtz, PLLC. A native of Saint Paul, Minnesota, Ms. Hoekstra boasts an impressive academic and professional record, including graduation from two of the nation’s top schools. She earned her Bachelor of Arts in Environmental Science from Columbia College, Columbia University in the City of New York. She relocated to Louisiana to attend Tulane Law School, where she earned her J.D. while also completing a certificate in Environmental Law. During her law school career, she spent a semester studying at the University of Wisconsin School of Law and visited on their International Law Journal as a Junior Member during her Hurricane Katrina evacuation semester. Ms. Hoekstra has been involved in complex litigation cases of all forms since 2007. Ms. Hoekstra has earned a solid reputation as a skilled writer and researcher and plays an integral role in several complex litigation cases, practicing in the areas of Pharmaceutical Mass Torts, Defective Device Mass Torts, and other complex litigation. She is currently a member of the Proton-Pump Inhibitors Plaintiff Executive Committee and the 3M Earplugs MDL Discovery and ESI Committee. Jennifer was central to the successful outcome in bellwether trials in the Genetically Modified Rice, Actos, and DePuy Pinnacle Hip MDLs, with more than $11 Billion in trial verdicts resulting from those cases. She has actively served as trial counsel or an integral member of the trial team in several of the 3M Earplug trials securing nearly $300 Million in compensatory damages for military veterans. She is licensed to practice before all Louisiana state and federal courts and the U.S. District Courts for the Northern District of Texas and Eastern District of Missouri as well as the 5th and 8th Circuit Courts. She is a member of the American Bar Association, the Louisiana Bar Association, the Acadiana Federal Bar Association, the Alexandria Louisiana Bar Association and the American Association for Justice. Mariana (Aroditis) McConnell joined Kiesel Law LLP in 2013 and her practice focuses on complex litigation, consumer class actions, and catastrophic personal injury cases. Currently, Ms. McConnell assists the firm in serving as Liaison Counsel in the SoCalGas Leak Cases (Porter Ranch) JCCP and class counsel for beneficiaries of the AFM and SAG-AFTRA Intellectual Property Rights Distribution Fund. Ms. McConnell has a strong foundation in complex civil litigation and a solid track record in representing Plaintiffs in all sorts of matters. Ms. McConnell has tried several personal injury trials to verdict in courts across the state. During law school, Ms. McConnell externed for the Honorable S. James Otero of the U.S. District Court, Central District. Ms. McConnell has been recognized as a Southern California Rising Star every year since 2015. Ms. McConnell earned her B.A. in Political Science from Pepperdine University and served as President of Kappa Alpha Theta Sorority. She then earned her J.D. from Southwestern Law School, cum laude.
