Strategies for Comprehensive Risk Evaluation and Coverage in Cyber Insurance

As the number of data breaches and other cyber-attacks has only continued to increase, statistics show that a majority of businesses will or have experienced cyber offensives targeting their data or intellectual property, among other issues. Like other forms of professional liability coverage, cyber insurance offers businesses the opportunity to invest in their protection, but decision-makers often have limited knowledge of the extent of the risks and associated needs or the extent of policies’ coverage. Attorneys advising businesses today will find an understanding of cyber insurance policies and the underwriting process essential to their practice.
In part two (2) of this online seminar, our expert panelists discuss current issues companies are facing regarding cyber insurance, including limitations in coverage, knowledge gaps in the cyber insurance policy application process, and understanding policy sub-limits. Our speakers then review recent litigations and conclude by providing key takeaways for attorneys and their clients on the topic of cyber insurance.

Josh is the chair of the Cyber Insurance Recovery Practice Group and the co-chair of the Marine Cargo Insurance Group. Josh won a multi-million dollar recovery in a landmark U.S. Court of Appeals, Sixth Circuit decision, on behalf of a retailer that suffered a data breach as a result of a computer hacking scheme. In finding coverage for the retailer's losses stemming from the breach, the Sixth Circuit rejected the insurance company's "direct loss" defense, instead applying a proximate cause standard. Because the "direct loss" defense is commonly cited in such cases, the decision is of particular importance to businesses purchasing fidelity, crime, and financial institution bond coverage.
