Here’s What NOT To Do - Shedding Light on NY’s New Pay Transparency Laws

This course is designed to provide attorneys with a comprehensive understanding of the NY State Pay Transparency Law and its implications for employers and employees. The course will cover recent developments in the law, including the 2017 Earned Safe and Sick Time Act in New York City, the 2019 Westchester County Wage Theft Prevention Act, and the 2020 Albany County Anti-Discrimination Law.
The course will focus on the requirements for pay transparency, including the obligations of employers to provide written notice of pay rates and other employment terms to employees and job applicants. It will also address the prohibition against retaliation for discussing wages, and the new requirement for employers to include a good faith pay range in all job advertisements.
In addition, the course will explore the definition of "employer" within the law, including the exclusion of temporary help firms, as well as the protections against retaliation for reporting labor law violations. It will also cover recent amendments to the NY State Pay Transparency Law, including changes to the scope of job postings covered by the law and the removal of record retention requirements.
Throughout the course, attorneys will learn how to advise their clients on compliance with the NY State Pay Transparency Law and how to help their clients avoid violations. They will also learn how to represent clients in cases involving alleged violations, including complaints filed with the New York State Department of Labor (NYS DOL) commissioner.
By the end of the course, attorneys will have a solid understanding of the NY State Pay Transparency Law and its implications for employers and employees, and will be equipped to provide expert advice and representation to their clients on compliance and enforcement matters.
